Demirci Gym B.V. Membership Terms & Conditions.

These Membership Terms & Conditions apply to all memberships, training packages, services, facilities, and related products offered by Demirci Gym B.V., located in Maastricht, the Netherlands.

By registering as a member, the member confirms that they have read, understood, and accepted these Terms & Conditions, the applicable membership form, the house rules, and any future reasonable updates communicated by Demirci Gym B.V.




1. Membership Agreement, Duration, and Renewal

1.1. The membership agreement starts on the date stated in the membership form, registration form, online checkout, or written confirmation from Demirci Gym B.V.

1.2. The initial membership period depends on the selected membership type, such as monthly, quarterly, semi-annual, annual, youth, student, family, trial, or promotional membership.

1.3. During the agreed initial membership period, the member is obliged to pay the full membership fees, regardless of attendance, use of facilities, illness, injury, holidays, relocation, change of personal circumstances, or non-participation, unless Demirci Gym B.V. agrees otherwise in writing.

1.4. After the initial fixed term has ended, memberships that are paid periodically may continue for an indefinite period and may be cancelled by the member with a notice period of 30 days.

1.5. Demirci Gym B.V. may offer fixed-term memberships, prepaid memberships, promotional memberships, or special-discount memberships. These memberships are binding for the full agreed duration and cannot be cancelled early unless required by mandatory law or agreed in writing by Demirci Gym B.V.

1.6. Annual, prepaid, promotional, discounted, or special-offer memberships end after the purchased duration, unless the member has agreed to renewal or continuation.

1.7. Demirci Gym B.V. reserves the right to refuse, suspend, or terminate a membership if the member provides incorrect information, fails to pay, violates these Terms & Conditions, violates the house rules, or behaves in a way that may harm the gym, staff, trainers, members, visitors, or reputation of Demirci Gym B.V.

2. Registration, Administration, and Member Information

2.1. A registration fee may be charged to cover administrative, onboarding, and system costs.

2.2. The registration fee is due immediately upon registration and may be collected together with the first membership payment.

2.3. Registration fees are non-refundable, including in cases of cancellation, non-attendance, injury, illness, suspension, or termination.

2.4. The member is responsible for providing correct and up-to-date personal information, including name, address, phone number, email address, date of birth, bank details, and emergency contact details where applicable.

2.5. Any changes to personal details or payment information must be communicated to Demirci Gym B.V. immediately.

2.6. Communications sent to the email address or contact details provided by the member are considered validly delivered.

3. Tuition Fees, Membership Fees, and Payment

3.1. Membership fees are due in advance and must be paid on time according to the selected payment method.

3.2. Payment may be made by SEPA direct debit, bank transfer, card payment, online payment, or any other method accepted by Demirci Gym B.V.

3.3. By choosing SEPA direct debit, the member authorizes Demirci Gym B.V. to collect the agreed fees from the member’s bank account.

3.4. The obligation to pay membership fees continues even if the member does not attend training sessions, does not use the facilities, is temporarily absent, is on holiday, is injured, is ill, relocates, or is unable to participate for personal reasons.

3.5. If a payment fails, is reversed, refused, cancelled, or not received on time, Demirci Gym B.V. may charge the member any bank costs, administrative costs, reminder costs, and reasonable collection costs incurred.

3.6. In case of late payment, Demirci Gym B.V. may immediately suspend access to training sessions, facilities, events, competitions, private groups, member benefits, and other services until all outstanding amounts have been paid.

3.7. Suspension of access due to non-payment does not suspend or cancel the member’s payment obligation.

3.8. If payment remains outstanding after a reminder, Demirci Gym B.V. may transfer the debt to a collection agency or legal representative. All reasonable judicial and extrajudicial collection costs will be payable by the member, to the extent permitted by law.

3.9. Demirci Gym B.V. may change membership fees, service fees, registration fees, administrative fees, and other charges. Members will be informed in advance where required.

3.10. Price changes due to inflation, increased rent, increased energy costs, tax changes, insurance costs, staff costs, supplier costs, or other operational cost increases may be applied by Demirci Gym B.V.

4. Cancellation by the Member

4.1. Cancellation must be submitted in writing by email to maastricht@demircigym.nl

4.2. Cancellation is only valid after Demirci Gym B.V. has confirmed the cancellation in writing.

4.3. The member is responsible for keeping proof of cancellation.

4.4. For memberships within the initial fixed contract period, cancellation only becomes effective at the end of the agreed initial period, unless Demirci Gym B.V. agrees otherwise in writing or mandatory law requires otherwise.

4.5. After the initial contract period, the member may cancel the membership with a notice period of 30 days.

4.6. The notice period starts on the date Demirci Gym B.V. receives the cancellation request.

4.7. All outstanding payments must be paid before the cancellation is completed.

4.8. Cancellation does not release the member from payment obligations that arose before the cancellation date or during the notice period.

4.9. No refunds will be issued for registration fees, paid membership fees, unused training sessions, missed classes, prepaid periods, credits, promotional offers, or other services, unless required by mandatory law or agreed in writing by Demirci Gym B.V.

5. Temporary Suspension, Freezing, Illness, or Injury

5.1. Memberships are not automatically suspended due to illness, injury, travel, holidays, school obligations, work obligations, relocation, lack of attendance, or personal circumstances.

5.2. Demirci Gym B.V. may, at its sole discretion, allow a temporary membership freeze in exceptional circumstances.

5.3. A membership freeze must be requested in writing in advance to maastricht@demircigym.nl and is only valid after written approval by Demirci Gym B.V.

5.4. Demirci Gym B.V. may request medical proof or other supporting documents before approving a freeze.

5.5. A temporary freeze may be subject to an administrative fee or freeze fee.

5.6. A freeze does not automatically shorten the contract period. Demirci Gym B.V. may extend the membership period by the length of the approved freeze.

5.7. Temporary cancellation for medical reasons is treated as a cancellation request and remains subject to the applicable 30-day notice period, unless Demirci Gym B.V. decides otherwise in writing.

6. Training Times, Facilities, and Availability

6.1. Demirci Gym B.V. determines the training schedule, class structure, instructors, opening hours, facilities, and available services.

6.2. Demirci Gym B.V. may adjust training times, class schedules, trainers, opening hours, membership benefits, locations, or facilities at any time when reasonably necessary.

6.3. Reasonable notice will be provided where possible, but urgent changes may be made without prior notice.

6.4. The gym may be closed on public holidays, official holidays, maintenance days, renovation days, staff training days, events, competitions, emergencies, or other necessary closure days.

6.5. Public holidays and closure days are included in the regular membership period and do not create a right to compensation, refund, discount, or membership extension.

6.6. A modified schedule may apply during summer periods, school holidays, Ramadan, Christmas periods, public holidays, competition periods, or other seasonal periods.

6.7. Demirci Gym B.V. does not guarantee the availability of specific trainers, specific classes, specific training partners, specific time slots, or specific facilities.

6.8. If a class is full, Demirci Gym B.V. may refuse access to that class for safety, quality, or capacity reasons.

7. Privacy and Personal Data

7.1. Demirci Gym B.V. processes personal data for membership administration, payment processing, communication, safety, service improvement, customer support, marketing, and legal compliance.

7.2. Personal data may include name, address, email address, phone number, date of birth, payment details, attendance information, membership details, communication history, and other information provided by the member.

7.3. Demirci Gym B.V. stores personal data securely and does not sell personal data to third parties.

7.4. Personal data may be shared with service providers where necessary, such as payment processors, software providers, accountants, legal advisers, debt collection agencies, or other parties required for business operations or legal compliance.

7.5. Demirci Gym B.V. may use cookies and similar technologies on its website to analyze website usage, improve services, and enhance user experience.

7.6. Members may contact Demirci Gym B.V. regarding privacy questions by email at maastricht@demircigym.nl.

8. Minors

8.1. Members under the age of 18 may only register with permission from a parent or legal guardian.

8.2. The parent or legal guardian is jointly responsible for payment obligations, conduct, safety, and compliance with these Terms & Conditions.

8.3. Demirci Gym B.V. may communicate with the parent or legal guardian regarding the minor’s membership, payments, behavior, attendance, safety, or other relevant matters.

9. Photos, Videos, and Marketing

9.1. Demirci Gym B.V. may take photos and videos during training sessions, events, competitions, seminars, or promotional activities.

9.2. Photos and videos may be used for social media, website content, advertising, promotional materials, and internal communication.

9.3. Members who do not wish to appear in promotional content must inform Demirci Gym B.V. in writing.

9.4. Demirci Gym B.V. will make reasonable efforts to respect such requests.

9.5. Members may not film or photograph other members, staff, trainers, or visitors without permission.

10. Force Majeure

10.1. Demirci Gym B.V. is not liable for failure or delay in providing services due to force majeure or circumstances beyond its reasonable control.

10.2. Force majeure includes, but is not limited to, fire, flood, extreme weather, government measures, pandemics, epidemics, power failures, internet failures, strikes, staff illness, building issues, safety risks, public-order issues, supplier failures, or other unexpected events.

10.3. Temporary closure, reduced schedules, alternative training formats, or modified services due to force majeure do not automatically create a right to refund, compensation, or cancellation, unless mandatory law requires otherwise.

11. Termination by Demirci Gym B.V.

11.1. Demirci Gym B.V. may immediately suspend or terminate a membership if the member:
fails to pay on time;

violates these Terms & Conditions;
violates the house rules;
behaves aggressively, disrespectfully, dangerously, dishonestly, or inappropriately;
damages property;
threatens staff, trainers, members, or visitors;
harms the reputation of Demirci Gym B.V.;
misuses the facilities, services, or membership;
provides false information;
or otherwise acts in a way that Demirci Gym B.V. reasonably considers unacceptable.

11.2. In case of suspension or termination under this article, the member remains responsible for all outstanding payments.

11.3. No refund will be issued in case of suspension or termination caused by the member’s behavior, breach, or non-payment.
